Кроме того: Colourbox is not liable for i) any loss or damage to the Materials or other materials submitted to Colourbox, ii) any misuse of the Materials or other damage caused by Colourbox's customers or end-users, and iii) any indirect, special, incidental or consequential damages of any kind.
Я считаю, что ключевой момент для того, чтобы понять, чем руководствуется Colourbox, находится в авторском договоре:
by accepting these terms and conditions the Supplier hereby irrevocably consents to and assigns to Colourbox and/or Colourbox Partners, and Colourbox Licensees a right of use to the Materials, including but not limited to a right to use the Materials in any format, volume or context, for any purpose which may include advertising, commercial use, non-commercial use, digital and analogue formats, original format, and cropped, manipulated, and/or edited formats and together with other images, texts or graphics except where prohibited by Colourbox's Editorial material usage regulations.
Это все сделано для того, чтобы партнеры Colourbox не имели недостатка в изображениях. А то, что он еще будет приторговывать, так это только плюс.
А то, что сюда все грузят, так это личное дело каждого, куда грузить. В 90% договор вообще не читают. Это, я думаю, относится и к покупателям
Consequently the Licensee may not print the Materials on products for resale or use the Materials as part of services whereby third parties are given access to the Materials either separately or as part of products such as postcards, calendars, posters, wallpaper, artwork, screensavers, templates and other items.
Т.е. как раз запрещено то, что у других обычно понимается под расширенным использованием.
The Licensee is entitled to use the Products in its own data processing and own work.
Согласитесь, размытая формулировка.
Я, пожалуй, им письмо напишу. А то, я так понял, что никто этого не делал. Или делал?
